Bovis Lend Lease Ltd fined for employee's fall

The Health and Safety Executive (HSE) warns construction companies to protect employees and sub contractors working at height.
Following a prosecution brought by the HSE Bovis Lend Lease Ltd of Harrow Middlesex was today fined £5000 plus costs of £7632 after a 38 year-old employee of one of its sub-contractors fell from an unguarded working platform on the Bridgewater Place construction site in Leeds, shattering his ankle.
HSE Inspector Sarah Hague said:
"This case demonstrates all too clearly how anyone working at height is at serious risk of injury if proper precautions are not observed and regular rigorous inspections are not carried out.
"In this instance the working platform was unguarded, with disastrous results for the unfortunate employee. A much greater awareness is needed amongst employers, employees, and indeed the public in general, something which has been underlined by HSE's recent nationwide Height Aware campaign."
The construction company pleaded guilty at Leeds Magistrates Court to charges brought by the Health and Safety Executive (HSE) under Section 3 (1) of the Health and Safety at Work etc Act 1974 after a joiner fell from an unguarded working platform while working on one of the three concrete cores of the building.
Section 3(1) of the HSW Act states: It shall be the duty of every employer to conduct his undertaking in such a way as to ensure, so far as is reasonably practicable, that persons not in his employment who may be affected thereby are not thereby exposed to risks to their health or safety.
The maximum fine in a Magistrates' Court for charges under Section 3 (1) of the HSW Act is £20,000.
